I'd bet the owners of Ox would like to get in on this suit.

Atomic Wings, Now Closed, Sues Jersey City Over Delays in Opening
By Jon Whiten • Oct 19th, 2010 • Category: Blog, Food, News

The Downtown Jersey City franchise of Atomic Wings took so long to open, it reached near-mythical status amongst a certain set of Jersey City loyalists, who waited about two years from the first rumors of the restaurant’s opening for it to actually begin serving chicken in July of 2009.

But a little more than a year after the Bay Street wings spot finally opened its doors, it closed them this August, eventually being replaced by the recently opened Bon Chon Chicken.

Now the local franchisee, Randy Catlin, has sued Jersey City and construction code official Michael Razzoli, saying there was discrimination in the permitting process that allegedly led to delayed approvals, a delayed opening, and, ultimately, the restaurant’s failure.

The city first tried to get the lawsuit tossed, but a judge denied that motion, and now the matter will move forward in court. Neither Catlin nor the city were interested in talking on the record about the pending litigation, but the City Council did approve last week a contract with Secaucus-based law firm Chasan, Leyner & Lamparello to represent the city in the legal battle. For now, the firm has been retained at a rate of $125 per hour, for a total contract not to exceed $35,000.

While the city did not comment on the specifics of the case, spokesperson Jennifer Morrill assures us that “the Healy administration seeks to help small and large businesses who wish to operate in Jersey City.”

Well, it looks like this place is closed. The signs announcing Bon Chon Chicken opening soon have been hung in the windows.

How late are they open? I can only think of eating wings with beers. :)

You obviously aren't drinking early enough. ;D

Went there about an hour ago to pick up dinner. I sampled the hot, nuclear and suicidal sauces, and went with nuclear. The cashier screwed up my order (forgot to add my fries w gravy to my original order) so I had to wait another 5 minutes or so, which really was no big deal.

Unfortunately, when I got home and fixed myself up a plate, it looked like this:

I hadn't noticed that there was no hot sauce whatsoever on the wings, and after checking the plastic bag that our food came in, saw that all the sauce pooled in the bag under the foam container. I didn't ask the sauce to be put on the side, which would've been OK had they placed the sauce in one of those little containers. But I couldn't find a sauce container so I'm wondering where they heck they put my nuclear sauce?

Anyway, I called Atomic Wings and asked to speak with a manager. He apologized and owned up to their mistake, and about 10 minutes later, I received this:

And now I look like this:

I went the boneless route...I tried the Buffalo Chicken Fingers with medium sauce and onion fries.  The service was slowish but the people there are obviously trying their best, and they are super accommodating and friendly.  I do agree with the Fang that I prefer White Star's sauce to the medium Atomic sauce but there are eight or so other Atomic sauces I haven't tried, so I don't really feel like I should judge them on one sauce.  The onion fries were super soggy (I did get it to go, but still) but overall it was a good experience.  I'd like to try other sauces and other things on the menu like the burger.

Never get anything that's meant to be crispy to go. The steam from the hot food will condense in the (usually plastic) container an sog everything the fuck up.

The same thing goes for any kind of squid. Squid is very rubbery when overcooked, and if you sit squid in, say, a bed of rice, for 10 to 20 extra minutes, you're going to have a plate of rubber bands to eat. My dad gets Chinese squid to go all the time, and I tell him not to, and he always does it anyway. Rubber band city. Yeccch.

def. should give this place a couple of weeks to work out the kinks and learn their own menu.
went in on Wednesday, yes the official opening day, and while the food was ok it took them over 40 minutes before serving it.  To boot, the guy working the register didn't know that the menu says sandwiches are served with choice of certain sides for extra $2 and instead charged me full price for small fries.  my friend ordered wings crispy/well done and they looked anything but.
glad this place finally opened but I won't be popping in for a bit just so they have a chance to perfect operations.

Went for late lunch today around 3:50. They had a surprising amount of people in there for that time of day. I ordered the wing and mac and cheese combo to go. It took them close to 25 minutes to bring it out to me, but when I got it home everything was fresh and hot.

The sauce on the wings was a bit more greasy then I'd like wasn't really sticking to the wings, but it had a good heat and the chicken itself was very good. The mac and cheese was pretty great, and all the other food that I saw coming out of the kitchen while waiting there looked really good, especially the onion rings.

All in all I'd say that they need some more time to get some kinks out, especially with the computer system, I saw a few wrong orders come out while I was there, and with the speed. But for now I'll stick with White Star for my wing needs, much quicker and with way better sauce.

Soft opening is happening now....I couldn't resist so I went in to check it out.

Ordered the Buffalo Sandwich and fries.  Way too much food for me to finish, but delicious.  They were cross cut (freedom) fries which I'm a fan of and I couldn't finish them.  The sandwich comes Grilled or Fried Buffalo and has an unapologetic spice kick to it.   :P  I was able to finish it, but shouldn't have.

I'm anxious to try the Suicide Hot Wings next time.

I saw the sign too. It's only taken them 35 years to open this location, hopefully they'll last longer then their neighbors.

If you really miss wings that much, may i suggest the event below.

It probably will occur before Atomic Wings opens and you could be famous.

The sign is back up and people are working on the interior.  There is a dumpster out front which is being used to clean out the basement.  Yeah, it could be for Palace but the permit is taped to the Atomic Wings window.  I poked my head inside the store and they're framing out the wall/counter that separates the kitchen from the rest.  I asked the worker when they'd be open and he said a few months.

The last thing we need is more chicken bones but I prefer this to an empty store.

atomic winges is alright but never really thought they were much better than wings to go at 400 newark in hoboken or plucku in NYC.  If you really want good wings and can plan ahead then order the frozen ones from Anchor bar in Buffalo, yes they ship!

I spoke to the owner about a month ago... they're going through the usual JC red-tape-go-round.... something about how they needed sprinklers so they put in sprinklers, then they were told since they're technically part of Palace Drugs that they had to pay to install sprinklers in Palace too... so they had to rip out what they did and start again. He said he hoped to be open by fall.
